Guardianship and custody petitions in Pakistan are filed under the Guardians and Wards Act 1890, and decided by the Guardian Court on what is called the welfare of the minor — not on which parent is the mother or the father. That surprises a lot of people, especially fathers who assume custody automatically goes to the mother, and mothers who assume the same in reverse. Neither assumption is correct in law, though in practice, for very young children, custody often does go to the mother under the concept of hizanat, subject to conditions.

What the court actually looks at is more practical than people expect: the child's age, which household offers more day-to-day stability, whether schooling would be disrupted, each parent's living situation and ability to care for the child, and — once a child is old enough to express a reasonable preference — what the child wants. None of these factors decide the case alone; the court weighs them together.

Custody and Visitation Are Usually Separate Questions

Losing primary custody does not mean losing access to your child. Visitation rights are normally addressed alongside custody, and we push to have both resolved in the same proceeding rather than leaving visitation to be fought over separately later, which only prolongs the dispute for everyone, especially the child.

When a Guardian Certificate Is Also Needed

If the child owns or stands to inherit property, a separate guardian certificate may be required to manage that property on the child's behalf, in addition to the custody order itself. This gets missed often, and it matters — banks and revenue authorities will not release funds or transfer property to a parent acting for a minor without one.
